1. Acceptance of Terms
By accessing or using myday ("the Service"), you agree to be bound by these Terms of Service. If you don't agree, please don't use the Service.
2. Description of Service
myday is a customer relationship management (CRM) platform that helps small teams manage leads, contacts, deals, and sales activities. The Service includes email integration, calendar scheduling, workflow automation, and related features.
3. Account Registration
To use myday, you must create an account with a valid email address. You are responsible for maintaining the security of your account credentials. You must notify us immediately if you suspect unauthorized access to your account.
4. Subscription and Billing
- myday Pro costs $19 per user per month, Business costs $39 per user per month
- 14-day trial available, with 60-day money-back guarantee
- Payments are processed securely by our PCI-compliant payment provider when you upgrade
- You can cancel anytime from your account settings
- Refunds are provided on a case-by-case basis
5. Your Data
You retain ownership of all data you enter into myday. We will not access, use, or share your data except as necessary to provide the Service or as required by law. You can export your data at any time via CSV export.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Send spam or unsolicited messages through our email features
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Upload malicious code or content
- Resell or redistribute the Service without permission
7. Email Integration
If you connect your email account (Gmail, Outlook, etc.), you authorize myday to access and sync your emails for CRM purposes. You can disconnect your email at any time. We comply with Google's and Microsoft's API usage policies.
8. Service Availability
We strive for 99.9% uptime but cannot guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We'll provide advance notice when possible.
9. Limitation of Liability
myday is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.
10. Termination
You can cancel your subscription at any time. We may suspend or terminate your account if you violate these terms. Upon termination, you'll have 30 days to export your data before it's deleted.
11. Changes to Terms
We may update these terms from time to time. We'll notify you of significant changes via email. Continued use of the Service after changes constitutes acceptance of the new terms.
12. Governing Law
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
